Employer facing prosecution following allegations of underpayment of Working Holiday maker

The Sydney based employer is also accused of breaching the sham contracting provisions of workplace laws by knowingly misclassifying the employee as an independent contractor. If proven, the Director of the company faces maximum penalties of up to $6600 per breach and his company faces penalties of up to $33,000 per breach.
